The customer hereby rents bicycles from Palma on Bike, subject to all terms and conditions agreement:

1. METHOD OF PAYMENT: Cash or valid credit card, paid at the moment of the delivery for the complete rental period reserved.

2. DEPOSIT: The customer will be asked for a valid credit card number and a proper ID (Passport, driving licence or National Identity Card of European Citizens) Also could be asked for a security deposit of 100 € per equipment. The deposit will be refunded on the finishing of the contract.

3. The customer who signs the rental contract has to be at least 18 years old and will be responsible for the equipment.

4. EARLY RETURN: If the customer returns the equipment early no refund will be made.

5. USE OF THE EQUIPMENT: The rented equipment may only be used by the designated customer and the member’s party as mentioned in the Rental Contract. The customer is obliged to take good care of the rented equipment and to protect them from damage, loss or theft. If any of the mentioned situations occurred during the rental period, the customer will be charged at the moment for the full costs at market prices. Palma on Bike will determine the conditions of the rented materials. The customer is obliged to lock the equipment properly at all times when unattended bicycles :( pass the lock through the saddle, frame and wheels and attach the bike to a fix post). It is highly recommended to keep the equipment with you when possible. In case of loss or theft of the bicycles, components or any other accessories, Palma on Bike will charge the customer the full cost of the missing items at market price.

6. RETURN OF THE EQUIPMENT: The renter has to return the equipment with all its accessories at the place, date and time mentioned. Any alteration must be authorized by the rental company. Unfulfilment of these conditions entitles the Company to demand by the local judicial authorities the return of the bike.

7. LIMITATION OF LIABILITY: Third party liability insurance coverage is included in the equipment rental price. The customer is responsible for adequate personal insurance coverage for risks that may occur during the rental period. Palma on Bike is not liable for any claims for body injury or harm, accidents, drown, death, damage caused to third person property or loss of personal belonging caused by weather, sickness, or any other causes. Kayaks: the customer should wear lifejackets while kayaking, and must be good swimmers.

8. HIRING-OUT COMPANY LIABILITY: The hiring-out Company has taken all reasonable precautions to prevent mechanical failure of rented equipment, but if this happens, the Company will not be responsible for any damage or loss caused to renter, directly or indirectly.

9. It is the responsibility of the customer and his/her group to respect Spanish traffic regulations.

10. Exclusive place of jurisdiction shall be Illes Balears, Spain. This contract shall be governed by Spanish law.

11. LAW FOR THE PROTECTION OF PERSONAL DATA: To comply with the Organic Law 15/1999 of 13 December and the R.D. 994/99 of 11 June, we inform you that the data you provide are stored in files owned by Palm On Bike and used as part of our internal management system. You have the right to access, modify, cancel and oppose the processing of said data.

TÉRMINOS Y CONDICIONES DE ALQUILER

El cliente alquila equipo/s de Palma on Bike, sujeto a todos los términos y condiciones del presente contrato:

1 .MÉTODO DE PAGO: En efectivo o tarjeta aceptada a la entrega del material y por el tiempo total del contrato de alquiler.

2. DEPÓSITO: En el momento de la entrega del material, al cliente se le exigirá un número de tarjeta de crédito válido, y documento de identidad tal como pasaporte, licencia de conducir o Tarjeta Nacional de Identidad en el caso de ciudadanos europeos. Podrá ser exigido un depósito de seguridad de 100 € por equipo. El depósito será devuelto una vez finalizado el plazo de alquiler contra entrega del equipo alquilado en las mismas condiciones.

3. FIRMA: Quien firma el contrato de alquiler deberá ser mayor de 18 años y se hará responsable por el equipo alquilado.

4. ENTREGAS ANTICIPADAS: No se hará reembolso por entrega de material antes de finalizar el tiempo de alquiler contratado.

5. UTILIZACIÓN DEL EQUIPO ALQUILADO: Los equipos de alquiler sólo pueden ser utilizados por los clientes designados en el contrato de alquiler. El cliente está obligado de tener buen cuidado y de tomar todas las precauciones necesarias para proteger el equipo alquilado de daños, pérdidas o robo. De producirse cualquiera de las mencionadas situaciones durante el periodo de alquiler, el cliente asumirá de manera inmediata la totalidad de los costes de reposición ocasionados a precios de mercado. Al final del periodo de alquiler un representante de Palma on Bike valorará en dado caso las perdidas o daños ocasionados. El cliente está obligado en todo momento de amarrar correctamente el equipo y demás material cuando no lo tenga a la vista (bicicletas: pasar el candado por el cuadro, sillín y ruedas y atar la bicicleta a un poste fijado al suelo o bici-parking). Se recomienda en todo caso mantener el equipo consigo mientras sea posible.

6. DEVOLUCIÓN DEL EQUIPO: El arrendatario devolverá el material alquilado junto con todos sus accesorios en el lugar, fecha y hora estipulados. Cualquier alteración deberá ser previamente autorizada por el arrendador. El incumplimiento de esta condición, faculta al arrendador a requerir judicialmente la devolución del material.

7. RESPONSABILIDAD CIVIL Y LIMITACIONES: Un seguro de responsabilidad civil está incluido en el precio de alquiler del equipo. El cliente es responsable de estar asegurado con una adecuada cobertura contra riesgos que se puedan presentar durante el periodo de alquiler. Palma on Bike no se hace responsable de reclamaciones por accidentes, ahogamientos, muertes, heridas, golpes o daños ocasionados a si mismos y a terceras personas o a su propiedad, o por perdidas de objetos ocasionados por cualquier razón fuera del control de Palma on Bike. Kayaks: El cliente declara ser buen nadador y hacer uso en todo momento de los chalecos salva vidas.

8. RESPONSABILIDAD DEL ARRENDADOR: El arrendador declara haber tomado las debidas precauciones para evitar fallos mecánicos del equipo alquilado, pero en caso de producirse estos, no asume ninguna responsabilidad por los perjuicios que directa o indirectamente pudieran causarle al arrendatario, como consecuencia de dichos fallos o averías.

9. Es responsabilidad del cliente y de su(s) acompañante(s) respetar las normas de tráfico españolas.

10. Este contrato se rige por la ley española. El lugar de jurisdicción será exclusivamente Illes Balears, España.

11. LEY DE PROTECCION DE DATOS: En cumplimento de lo establecido en la Ley Orgánica 15/1999, de 13 de diciembre y el R.D. 994/99 de 11 de junio, le informamos que los datos que Ud. Proporciona se recogen en ficheros propiedad de Palma On Bike y se utilizan en nuestra gestión interna, teniendo Ud. Derecho de acceso, rectificación, cancelación y oposición al tratamiento de los mismos.
